On Wednesday, Federal Oral Court 2 ordered the preventive seizure of assets belonging to former Argentine President Cristina Fernandez and her children, Maximo and Florencia Kirchner.

The Court justified its decision as a measure that could be used to cover the “economic damage” to the Argentine state of about US$456 million caused during the proceedings in the “Vialidad case.” For now, however, the judicial decision does not involve the forfeiture or auction of the assets.
“The objective is to prevent the assets from being transferred, encumbered or removed from the jurisdiction while the procedure to determine which assets will ultimately be executed moves forward,” explained radio MDZ Mendoza.
The order covers the apartment in the Constitucion neighborhood of Buenos Aires, where Cristina Fernandez is currently serving her sentence under house arrest.
Few citizens in a constitutional democracy would accept a politically driven prosecution imprisoning a former president or barring an opposition leader from office for life.

The preventive freeze also includes properties in the Recoleta neighborhood, a duplex, seven parking spaces, an apartment and a storage unit located in the Puerto Madero neighborhood, land, buildings, parking spaces, a chalet in Rio Gallegos, and a property in Santa Cruz province.
Given the amount of “the damage,” the Federal court also decided to extend its order to the assets of Maximo and Florencia Kirchner and requested banking reports on their savings accounts and safe-deposit boxes.
The ruling does not alter the operational conditions of the former President’s house arrest at her current residence, while Fernandez’s defense has challenged the technical basis of the conviction, which they plan to take before international organizations.
