Argentina’s President Javier Milei enacted a controversial emergency decree this Thursday to deport and ban foreigners accused of promoting hate speech against Argentina or desecrating national symbols, intensifying his administration’s far-right, Trump-inspired immigration crackdown.
The Decree of Necessity and Urgency (DNU) , published on July 29, establishes the immediate expulsion and entry ban for any foreign national who “incites or directs messages of hate, discrimination, or violence against the Argentine people” or “outrages patriotic symbols.”
The Office of the Argentinean President justified the authoritarian measure as a non-negotiable defense of national sovereignty, stating that those who attack the republic are no longer welcome.

This legislative maneuver aligns with the conspiracy theories promoted by Javier Milei regarding an alleged “anti-Argentine campaign” on social media. Without presenting any empirical evidence, the far-right President has blamed the progressive governments of Brazil and Mexico, as well as the Democrat Party of the United States, for orchestrating online hostility during the recent soccer World Cup in North America.

The procedure requires the Chief of staff to refer the decree to the Permanent Bicameral Commission of the National Congress, which has ten working days to rule on the validity of the text.
The decree enters into force upon its publication in the Official Gazette, although its continuity depends on the endorsement of at least one of the legislative chambers.
Growing Judicial Backlash
This new decree reinforces a series of xenophobic policies implemented by the current administration, which have already faced major defeats in the Argentinean courts.
Previously, Milei signed the decree 366/2025, another Trump-style decree that sought to severely restrict access to citizenship, healthcare, and public education for migrants, while removing the judiciary’s authority over naturalization processes. However, the National Electoral Chamber declared it as unconstitutional and void.
Furthermore, just one month ago, the Milei administration launched the Migratory Security Program. This initiative authorized the Federal Police, Gendarmerie, Naval Prefecture, and the Airport Security Police (PSA) to act as auxiliary migration agents. The program grants these federal forces sweeping powers to conduct intelligence, detention, and deportation of undocumented immigrants, turning everyday law enforcement into a tool of systemic harassment against migrant communities.
