
The Brazilian Government has tightened regulations for online gambling advertising with a package of new rules, including the mandatory inclusion of explicit warnings about the risks of addiction and financial losses in all advertising materials.

According to the new rules, published in an extra edition of the Official Gazette on Friday night, from July 17 onwards, gambling operators must clearly include three warning phrases designed by the Ministry of Finance in their advertisements, similar to what is already done with tobacco and alcohol advertisements.
Accompanied by the notice “the Ministry of Finance warns,” advertisements must explicitly state that gambling “can cause addiction,” “makes you lose money,” or “is not an investment.”
The legislation also specifies that warning clauses must appear strictly horizontally; be clear, legible, and proportionate to the rest of the advertisement, and occupy at least 10% of the total size or length of the advertisement.

It will also be considered abusive, misleading, or fraudulent to issue live betting strategies, predictions, or technical opinions that, due to their closeness to editorial content, influence or induce the viewer to place an immediate bet.
The measure seeks to curb direct inducement of viewers by commentators and public figures, a practice that has become common during broadcasts of major sporting events, such as the 2026 World Cup.
During high-audience events, especially on massive streaming platforms, it became common for narrators and commentators themselves to recommend specific plays in real-time, inducing the audience to believe that a certain bet was an unmissable opportunity.
It is also prohibited to present gambling as a source of income, an employment alternative, a form of investment, or a solution to financial problems, or to use celebrities and influencers to suggest that gambling is a sign of personal, social, or financial success.
Likewise, both individuals and legal entities will have to verify that the company is on the official list of operators authorized by the Government before publishing or promoting any gambling advertisement, and the official license number must be visibly displayed.
App stores must prevent children and adolescents from downloading gambling apps, and social media platforms must implement effective filters to ensure that no gambling advertisements or promotional content appear for users under 18 years of age.
Since Luiz Inácio Lula da Silva returned to power on January 1, 2023, the Government has tightened oversight of so-called ‘bets’, with stricter conditions, in addition to applying a specific taxation regime that did not exist before.
Since then, authorities have blocked more than 30,000 domains of digital betting platforms that did not comply with the conditions provided by law.
The Government also prevented beneficiaries of Bolsa Familia, Lula’s flagship program that provides subsidies to low-income families, and other social initiatives from placing online bets.
