
With only three days left before the legally mandated declaration of final results, National Electoral Council (CNE) counselor Marlon Ochoa announced Saturday he will not endorse any proclamation unless all outstanding tally sheets are audited and consolidated.

“Approving corrections without a prior audit opens a flank of legal and political controversy,” Ochoa warned during an emergency virtual session of the three-member board.
Ochoa revealed that 7,901 tally sheets for congressional races and 2,413 for municipal councils remain inconsistent or unprocessed, making any declaration under Article 283 of the Electoral Law “illegal” if based on partial data.

His stance pits him against CNE President Ana Paola Hall and counselor Cossette López, who overnight authorized manual corrections to 4,084 sheets in eight departments, claiming the move “significantly improves” the count.
The pair admitted the process has been marred by “hostility, threats and operational gaps,” but insist the board will meet the December 30 constitutional deadline.
Ochoa countered that the late-night adjustments—covering 7,697 congressional and 5,581 municipal forms—could alter 3,168 already-validated sheets, tipping narrow margins in key battlegrounds such as Cortés and El Paraíso.
He demanded the TREP follow-up commission specify which boxes will be changed and under what technical criteria before any vote is taken.
With the clock ticking, the council’s internal deadlock raises the specter of post-election litigation, street protests and fresh calls for international observation if a consensus—or a clean audit—is not reached before Tuesday’s scheduled declaration.
